Business ownership and clinical authority are two different questions. An RN may own a business entity, but RN ownership does not authorize the RN to diagnose, prescribe, or operate outside the nursing scope — and it does not automatically make the business exempt from Florida Health Care Clinic licensure. Structure the ownership, AHCA, and prescribing pieces separately.

Does an RN qualify for the practitioner-owned AHCA exclusion?
Florida’s practitioner-owned exclusion in §400.9905 identifies specific licensed practitioners and expressly references APRNs under §464.012. A standard RN license by itself should not be assumed to satisfy that exclusion, so an RN-owned weight-loss business may need a different AHCA pathway depending on structure and services. Determine this before opening.
What clinicians does an RN-owned weight-loss clinic still need?
Even if the RN owns the company, the business still needs authorized clinicians for medical evaluation, diagnosis, prescribing, and patient-specific treatment decisions. An RN may administer medications and treatments when properly prescribed or authorized, within nursing scope — ownership does not expand the nursing license.
